1. Who we are

Night Bandit is made by Martin Michaux, Avenue Maurice 24, 1050 Ixelles, Belgium ("we"). Contact: hello@nightbandit.app. By using the app you accept these terms. If you don't accept them, please don't use it.

2. Who can use it

Night Bandit is for people aged 13 and over, to limit their own phone use. It isn't a parental-control app and isn't designed for children.

3. What Night Bandit does, and what it can't promise

• It's a self-control tool: it locks the apps and websites you choose, at the times you choose, and asks you to walk to a spot at home to unlock them early.
• It isn't a medical device and doesn't diagnose or treat anything. If your phone use worries you, talk to a health professional.
• It can be switched off on purpose, by you, and your phone can stop it too (battery savers, system updates, permissions being revoked). We work hard to make blocking reliable, and the app tells you when it isn't protecting you, but we can't guarantee that every app is blocked every time.
• Calls, messages, your alarm and your phone's settings are never blocked. Even so, don't rely on Night Bandit for anything safety-critical.

4. Walk safely

Unlocking means walking to a spot in your home, often at night. Pick a spot you can reach safely, turn a light on, and never scan while driving, cycling or crossing a street.

5. Price

Night Bandit is free. If we offer paid features later, they'll be sold through Google Play or the App Store: the price is shown before you pay, and their terms, including cancellation and refunds, apply to the purchase. We'll update these terms before any paid feature launches.

6. Your licence, and ours

We give you a personal, non-transferable right to use Night Bandit on devices you own or control. The name Night Bandit, Nox the raccoon, the artwork and the code belong to us. Please don't copy, resell or reverse-engineer the app, except where the law allows it.

If you downloaded Night Bandit from the App Store, Apple's standard licence agreement for apps also applies. If the two conflict, Apple's agreement wins for the App Store version.

7. Your data

How the app handles data is explained in our privacy policy. In short: today, what the app records stays on your phone.

8. Responsibility

Night Bandit is provided "as is". As far as the law allows, we're not liable for indirect losses, such as a missed message during a curfew you set, or for data lost when you uninstall the app or change phones.

Nothing in these terms limits your rights as a consumer, or our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be limited by law.

9. Stopping

You can stop at any time by uninstalling the app. We may change the app, or stop offering it. If we stop, we'll give notice in the app or on this site where we can.

10. Changes to these terms

We'll update the date at the top when these terms change. For important changes, we'll tell you in the app before they apply.

11. Law and disputes

These terms are governed by Belgian law. If you live in another country, you also keep the protection of its mandatory consumer rules, and you can bring a claim before the courts where you live. Before going to court, please write to us: most problems are quicker to fix by email.
